QCODE.MY provides a QR Code generator service or SaaS (software-as-a-service) that allows users to create and manage QR codes through our online platform.

2.3 User Responsibilities

As a user of our Service, you agree to use the Service in compliance with all applicable local, state, national and international laws and regulations. You are responsible for all activities conducted through your account. Misuse of the Service includes, but is not limited to:
- Engaging in illegal activities
- Violating intellectual property rights
- Attempting to gain unauthorized access to the Service

2.4 Restrictions of Use

The Service is restricted from being used for:
- Creating QR codes for malicious websites or content
- Distributing viruses or malware
- Harassing or harming others

2.5 Payment Terms

If you subscribe to our paid Service, you agree to pay the applicable fees. Payments must be made via valid payment methods. Payments are non-refundable except as required by law.

2.6 Termination

We may terminate or suspend access to our Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users.

2.7 Liability Limitation

To the maximum extent permitted by law, iMOOLAH NETWORK and QCODE.MY shall not be liable for any indirect, incidental or consequential damages, including but not limited to lost profits, data loss or damage to computer systems resulting from the use of or inability to use the Service.

2.8 Governing Law

These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

2.9 Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

3. Acceptable Use Policy (AUP)

This Acceptable Use Policy ("AUP") outlines acceptable and unacceptable use of QCODE.MY ("Service") provided by iMOOLAH NETWORK ("we", "us", "our").

3.1 Prohibited Activities

Users of the Service may not:
- Use the Service for any unlawful purpose or to solicit the performance of any illegal activity
- Distribute viruses, malware or any other harmful applications or code
- Attempt to gain unauthorized access to any part of the Service, user accounts or networks connected to the Service
- Harass, abuse, or harm others using the Service
- Impersonate another person or entity
- Use the Service to share illegal, harmful or pornographic content
- Engage in conduct that is likely to disrupt or affect the functionality of the Service

3.2 Violations

ANY VIOLATIONS OF THIS AUP MAY RESULT IN IMMEDIATE SUSPENSION OR TERMINATION OF YOUR ACCOUNT. WE RESERVE THE RIGHT TO TAKE ANY APPROPRIATE LEGAL ACTION AGAINST USERS WHO VIOLATE THIS POLICY.

4. Disclaimer of Warranties

QCODE.MY provides the Service "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free or free of viruses or other harmful components.

To the fullest extent permitted by applicable law, iMOOLAH NETWORK and QCODE.MY disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose. We make no warranties or representations about the accuracy or completeness of the Service or the content accessible through the Service.

4.1 Changes and Modifications

We reserve the right to modify or discontinue the Service at any time without notice. We will not be liable to you or any third party for any modification, suspension or discontinuation of the Service.

5. Limitation of Liability

To the maximum extent permitted by law, iMOOLAH NETWORK and QCODE.MY shall not be liable for any indirect, incidental or consequential damages, including but not limited to lost profits, data loss or damage to computer systems resulting from the use of or inability to use the Service.

In no event shall iMOOLAH NETWORK'S and QCODE.MY's aggregate liability exceed the amount paid by you, if any, for accessing or using the Service during the twelve months preceding the event giving rise to the liability.

5.1 Governing Law

These terms and your use of the Service are governed by the laws of Malaysia, without regard to its conflicts of law rules.

6. Cookie Policy

QCODE.MY ("we", "us", "our") uses cookies and similar tracking technologies to track the activity on our Service and hold certain information.

7. Service Level Agreement (SLA)

QCODE.MY guarantees an uptime of 99.9% for its service. In case of downtime, refer to our Uptime Service Guarantee for details on remedies and exclusions.

7.1 Service Availability

We strive to ensure that the Service is available at least 99.9% of the time in any given calendar month, excluding scheduled maintenance and permitted downtimes.

7.2 Scheduled Maintenance

Scheduled maintenance will be carried out during low traffic periods and users will be notified at least 24 hours in advance. Scheduled maintenance is excluded from the uptime calculations.

7.3 Permitted Downtime

The Uptime Guarantee does not apply to downtime caused by:
- Scheduled maintenance
- Force majeure events (natural disasters, acts of war, etc.)
- Acts or omissions by the user
- Third-party services and connectivity issues
- Emergency maintenance
- Beta services
- User violations of the ToS
- System upgrades and implementations

7.4 Service Credits

If we fail to meet the Uptime Guarantee, affected users are eligible for Service Credits. Claims must be submitted within 15 days post-month.
- 0.1% - 0.5% downtime: 5% credit of the monthly subscription fee
- 0.5% - 1% downtime: 10% credit of the monthly subscription fee
- >1% downtime: 20% credit of the monthly subscription fee

7.5 Claim Process

Submit claims by contacting our support team with a detailed description of the incident. Include dates, times and the impact on your business operations.

7.6 Data Backup and Recovery

QCODE.MY performs regular backups of customer data to ensure data integrity and availability. However, the following conditions apply:
- Backup Frequency: Data is backed up on a daily basis.
- Retention Period: Backup data is retained for a period of 30 days.
- Recovery: In the event of data loss due to a system failure or other unforeseen incidents, we will initiate data recovery from the most recent backup
- Backup Limitations: While we strive to ensure data integrity, iMOOLAH NETWORK and QCODE.MY are not responsible for data loss caused by user error or unauthorized access to the Service.

7.7 Liability Limitation

Service Credits are the exclusive remedy for downtime. iMOOLAH NETWORK and QCODE.MY are not liable for any indirect or consequential damages.

7.8 Data Security

We employ industry-standard security measures, including encryption and access controls, to protect user data. However, users are responsible for maintaining secure passwords and safeguarding their own account information.

7.9 Changes to the SLA

We reserve the right to modify this SLA. Changes will be effective immediately upon posting on our website.
